• Use the Services only for lawful purposes and in compliance with all applicable local, state, national, and international laws, including anti-money laundering (AML) and know-your-customer (KYC) regulations.
• Not engage in fraudulent, deceptive, or illegal activities, including but not limited to money laundering, fraud, or trading in prohibited assets.
• Not attempt to bypass, disable, or interfere with the security features of the platform, including escrow mechanisms.
• Not use automated tools (e.g., bots, scrapers) to access or manipulate the platform without prior written permission from Peercoinix.

Violation of these terms may result in suspension or termination of your account and access to the Services.

4. Escrow Services and Transaction Fees

Peercoinix facilitates secure cryptocurrency transactions through escrow services, where funds are held by Peercoinix until transaction conditions are met. You acknowledge and agree that:

• Peercoinix charges transaction fees for escrow services, as disclosed on our platform at the time of the transaction.
• Fees are non-refundable unless otherwise specified or required by law.
• You are responsible for ensuring sufficient funds or cryptocurrency are available in your wallet to complete transactions and cover associated fees.
• Peercoinix is not responsible for losses due to market fluctuations, wallet errors, or failure to follow transaction instructions.

5. Risks of Cryptocurrency Trading

Cryptocurrency trading involves significant risks, including but not limited to:

• Price volatility that may result in substantial financial losses.
• Technical issues, such as blockchain network failures or wallet security breaches.
• Regulatory changes that may affect the legality or value of cryptocurrencies.

By using Peercoinix, you acknowledge these risks and agree that Peercoinix is not liable for any losses incurred as a result of your trading activities, except in cases of gross negligence or willful misconduct by Peercoinix.

6. Intellectual Property

All content, trademarks, logos, and intellectual property on the Peercoinix platform, including but not limited to text, graphics, software, and design elements, are the property of Peercoinix or its licensors. You may not:

• Reproduce, distribute, or modify any content from the platform without prior written consent.
• Use Peercoinix’s name, logo, or trademarks for any purpose without permission.

You are granted a limited, non-exclusive, non-transferable license to access and use the Services for personal, non-commercial purposes, subject to these Terms.

7. Termination

Peercoinix may suspend or terminate your access to the Services at any time, with or without notice, for reasons including but not limited to:

• Suspected fraudulent or illegal activity.
• Failure to comply with KYC/AML requirements.
• Inactivity on your account for an extended period, as determined by Peercoinix.

Upon termination, your right to use the Services will cease, and any pending transactions may be canceled or completed at Peercoinix’s discretion. You remain liable for any fees or obligations incurred prior to termination.

8. Limitation of Liability

To the fullest extent permitted by law, Peercoinix, its affiliates, officers, directors, employees, and agents will not be liable for any indirect, incidental, consequential, or punitive damages, including loss of profits, data, or cryptocurrencies, arising from your use of the Services. Peercoinix’s total liability for any claim will not exceed the amount of fees paid by you for the specific transaction giving rise to the claim.

The Services are provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

9. Indemnification

You agree to indemnify and hold harmless Peercoinix, its affiliates, officers, directors, employees, and agents from any claims, losses, damages, liabilities, or expenses (including legal fees) arising from:

• Your use or misuse of the Services.
• Your violation of these Terms or applicable laws.
• Your infringement of any third-party rights, including intellectual property rights.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of the Services will be resolved through binding arbitration in Los Angeles, California, in accordance with the rules of the American Arbitration Association. You waive any right to participate in a class action lawsuit or class-wide arbitration.
